With regard to the new problems raised by online defamation, the NPC's Decision on Safeguarding Internet Security stipulates that, in order to protect the personal and property rights of individuals and organizations, anyone who makes use of the Internet to insult or to slander other people with fabricated stories shall bear criminal responsibility if his act constitutes a crime. The Decision also provides that, to maintain the order of the socialist market economy and social administration, anyone who make use of the Internet to damage other people's business reputation and product reputation shall be investigated for criminal responsibility if his act constitutes a criminal offense. This law thus provides legal support and guidelines for Chinese courts to criminalize online defamation in serious circumstances. From both a historical and a realistic point of view, the key to resolving defamation issues is to establish a case of infringing on the reputation. According to the 1993 SPC Interpretation , a tort involving defamation shall have at least four components: the reputation of the victim has been damaged; the conduct of the offender is illegal; there is a causal relationship between the conduct of the offender and the damage to the victim; and the offender is subjectively at fault. In Chinese judicial practice, these four elements have been specified respectively as follows: (1) publication—the content has been published; (2) defamation—the content is defamatory; (3) identification—the defamatory content specifically points to the plaintiff; and (4) fault—the defendant is subjectively at fault. The following sections will examine how these four adjusted elements have been applied to online defamation, and what additional adjustments have been made to solve special problems created by the Internet.
